Certain protective measures of the Ordinance on Industrial Safety and Health lead to disproportionate hardship in individual cases. Exceptions may be granted upon written application.

Exceptions to the Ordinance on Industrial Safety and Health may be granted upon written application if the application of the regulations would lead to disproportionate hardship in individual cases. The exception must be justifiable from a safety point of view and compatible with the protection of employees and, where installations requiring monitoring are concerned, also with the protection of other persons.

Responsibility lies with the regional councils (RP).

Application with the following information

• Reason for requesting the exception, description of the disproportionate hardship,
• Affected activities and procedures,
• number of employees likely to be affected,
• technical and organizational measures to be taken to ensure safety and avoid hazards,
• Expert opinion, at the request of the authority

The application of the provision leads to disproportionate hardship in individual cases.

The legal remedy will be communicated in the notification.
